Disqualification From Driving
If you have been charged with a serious driving offence or have accumulated too many points on your licence within the last 3 years (or 2 years if you are a new driver), you could be facing a disqualification from driving. The length of a driving disqualification will depend on the nature of the offence and on your driving record. For example, if you tot up 12 points on your licence, you could be banned for 6 months, but if it is your second disqualification in 3 years, that could be a 12-month ban, while a third ban could result in a 2-year disqualification from driving.
Discretionary driving bans, or instant driving bans, are awarded at the discretion of the court for offences that are deemed to be so serious that a fine and licence endorsement (penalty points) would be inadequate. A serious speeding offence could bring about an instant ban of 7 to 56 days, or in some cases longer, as could careless driving, driving without insurance, or a traffic signal offence.
A mandatory ban can be given for the most serious offences, such as careless driving, dangerous driving or drink driving.
If you are disqualified from driving for more than 56 days, you will have to apply to have your licence’s validity restored.
